Which jurisdiction will the case will be heard?
A fictional jurisdiction.

Comments from the author of the problem:

1) New Dakota is not a public law 280 state. 

2) There is no issue related to exhaustion of tribal court remedies in the problem. 

3) There is no tribal constitutional language or authority that deals with the free exercise claim.  The only relevant tribal constitutional provision is that contained in the problem that addresses tribal membership rules.

Q. Did Mr. Grey Eagle apply for a permit under both the MBTA and BGEPA or only one of them? If he only applied for one permit which one?
A. 50 cfr 22 BGEPA

Q. Did Mr. Grey Eagle have bald or golden eagle feathers, or both?

A. For the purposes of this problem, presume that he had both golden and bald eagle feathers. 

Q. Will participants have access to all the submitted briefs prior to oral arguments?

A.I assume that you are asking if you can have access to other team’s
briefs. If my assumption is correct then pursuant to rule 8.2(c) the
answer is no, you will not have access to any brief besides your own, upon discretion of the Rules Committee.
